This Policy does not cover: (1) personal data managed by our Customers (employers using our Services, as further described below), which is governed by separate agreements and data processing agreements with those Customers; (2) personal data collected by external websites linked to or accessible from our Services; (3) personal data our partners collect directly from you and control; (4) personal data we process about our employees or job applicants in response to our job offers; and, (5) De-Identified Platform Data. De-Identified Platform Data is non-personal data derived from personal data, including aggregated, de-identified, or anonymized data, statistical data, insights, or predictive data that cannot be reasonably reversed engineered to identify you. We use De-Identified Platform Data to provide insights to Customers, improve our Services, and develop new features. Because this data does not personally identify you, we can use and disclose it at our discretion.
We are the data controller for the personal data discussed in this Policy, except as specified in the “Where We Are a Service Provider” section below. This means we are responsible for deciding how and why your personal data is processed, ensuring compliance with data protection laws like GDPR and CCPA for users globally, including those potentially interacting with organizations like the Michigan Department Of Human Services through our platform.
Where We Are a Service Provider
Our Customers include various organizations such as government agencies at the federal, state, local, and tribal levels, including departments and offices like the Michigan Department of Human Services, as well as private businesses, and educational institutions from K-12 schools to universities. These Customers utilize our Services to streamline their human resources processes, including evaluating job applicants and managing their personnel relationships. In this context, the Customer generally controls and manages the personal data, which can include sensitive information like biometric data for time tracking, precise geolocation, health information, and demographic details such as race and ethnicity related to employment. We act as a “data processor” or “service provider” as defined under applicable data protection laws, processing data on their behalf. Our legal obligations in this role are defined in our contracts and policies with Customers. It is the Customers, not us, who determine the types of personal data collected to manage their relationships with you.
For example, if you apply for a job with a Michigan state agency or your employer uses our Services for personnel management, the personal data collected is generally controlled by that employer, our Customer. This Policy does not detail how our Customers process your personal data. We strongly encourage you to review the Customer’s privacy policy to understand their data practices. If you have questions about how a state agency, such as the Michigan Department of Human Services, processes your personal data within our Services, please contact that agency directly.
When we act as a data processor or service provider, our Customer contracts and policies require us to either direct you to contact our Customer or redirect your inquiry to them. This ensures that the organization controlling your data can directly address your concerns.
Personal Data We Collect About You and Why.
This section outlines the categories of personal data we collect, including data collected over the past year, and the reasons for collecting it. We collect and process personal data to provide you with the Services, to fulfill our contractual obligations to our Customers, to respond to your requests, and to pursue our legitimate business interests. We also automatically collect data as you use the Services and obtain personal data from other sources. Your personal data will only be collected and used for the purposes stated in this Policy, where you provide additional consent, or as required by law, including national security or law enforcement requirements.
Information Provided by You.
We collect personal data directly from you when you use our Services via your computer, mobile device, or other device, when you attend our events, or when you communicate with our personnel. The categories of personal data we collect include:

Even if you opt out of tailored advertising, you may still see ads; they will just be generic. We are not responsible for the opt-out links mentioned above, your choices using them, or their continued availability or accuracy.
Information from Other Sources
We receive your personal data from various third-party sources, including your employer (our Customer), data brokers from whom we purchase personal data, partners (including those listed on our Marketplace), accreditation agencies, and co-organizers and sponsors of our events and webinars.
Partners: We use data from partners for joint product and marketing efforts. This includes profile data on background checks and assessments, payment processing updates, communication analytics, and profile data from integrated systems chosen by employers. If you use social logins like Facebook, we import requested data from your account.
Data brokers: We purchase contact data to enhance and correct our collected contact and employment data, including name, email, phone number, employer, job title, and expertise area.
Public sources: We collect personal data from public websites and government sources, such as name, email, job title, employer, and professional expertise. This public data can be relevant for professionals interacting with or seeking roles within public service organizations like the Michigan Department of Human Services.

Information Collected When Using the PowerLine Application
The PowerLine Application (“App”) is designed to support your mental wellbeing by providing resources and connecting you with others with similar experiences. If your employer sponsors your access to the App, we collect minimal personal data (name, email address) to set up your access. Your interactions on the App are anonymous to other users, who will only see an anonymous identifier. Be cautious about sharing personal data within the App. We collect usage data only as necessary for your interaction with the App, including:
- Measurement data: App version, device model, OS version, language and region settings, timestamp.
- App crash reports: Data related to crashes, including device state, model, OS version, and software processes involved.
- App usage and interactions: Statistics on user behavior to understand App interaction and for error reporting.
Information We Disclose.
We disclose personal data to other parties for the purposes described in this Policy or as legally required. Below are the categories of entities we have disclosed personal data to over the past year.
To Customers.
We share personal data with our Customers (your current or potential employers) who use our Services. For example, if you apply for a job, we disclose your data to the employer to facilitate the hiring process. If your employer uses our Services, your data within those Services is accessible to the employer’s authorized users, subject to their security settings. If you sign up for an Access membership, we may share your data with Customers and their agents for recruitment purposes. You can cancel your Access membership anytime. This is particularly relevant for individuals seeking employment with public service entities like the Michigan Department of Human Services, as their application data would be shared with them through our platform.
To Service Providers.
We disclose personal data to service providers who perform services on our behalf. These services include support, data security, email, web hosting, research and analytics, data enrichment, marketing and advertising, payment processing, payroll, customer conferences, and customer relationship management.
Research and Event Partners/Sponsors
We collaborate with other entities for research, with privacy safeguards in place. We publish or allow others to publish insights based on aggregated, anonymized, de-identified, or non-personal data.
If you access content or attend an event or webinar we host or co-host, we may disclose your data to event or webinar sponsors. Sponsors may also act as data controllers, and their privacy policies will apply to their processing of your data.

Marketing Communications
We may send you marketing and promotional emails in accordance with applicable law. To opt out of email marketing, notify us at [email protected] or use the unsubscribe instructions in the email. Even if you opt out of marketing communications, we will still send you essential administrative and transactional messages, such as updates to legal terms.
Rights Regarding Your Information
Depending on your jurisdiction, you may have rights under data protection laws to request information related to your “personal information” or “personal data.” You have the right to ask us to:

We do not knowingly sell the personal information of minors under 16 years of age.

Your Choices Regarding “Sharing” and “Selling”

Additional California Privacy Rights
In addition to the rights described in “Your Choices Regarding ‘Sharing’ and ‘Selling,’” California residents have rights under CCPA as detailed in the “Rights Regarding Your Information” section.
CCPA allows you to limit the use or disclosure of your “sensitive personal information” if used for specific purposes. We do not use or disclose sensitive personal information (like health, ethnicity, biometric data) except for disclosed and permitted business purposes where there is no right to limit under CCPA.

Do Not Track
Do Not Track (“DNT”) is a privacy preference in web browsers to inform websites not to track browsing activity. Your Rights and Control under EU GDPR.
Data Controllers and Processors.
Our Customers use our Services for job postings, applicant evaluation, HR management, and workforce training. Customers control what personal data is collected, how it is used, retention, and disclosure. Under EU GDPR, the Customer is the data controller, and we are the data processor. If you use Services via a paid subscription, your features are determined by the Customer Contract between NEOGOV and your organization (Customer). Customer Contract terms prevail in case of conflict with these Terms.
If you use a SaaS Application for a Customer, you agree to these Terms and Privacy Policy and are responsible for all actions through your account. If added to a SaaS Application, the administrator controls your use, including access, permissions, and third-party integrations. Content you submit may be managed by the administrator. Your account may be managed by the entity owning the email domain used for registration.

Eligibility. Services are for users 18 or older. By using Services, you warrant you are of legal age to contract with us. If not, do not use Services. We are based in California, USA. If you choose or receive login credentials, treat them as confidential and do not disclose them. Your account is personal, and you must not allow others access using your credentials.
Between you and others (including Customers), your account is yours. However, if a Customer purchased Services for your use, they can control access and get usage reports.
You agree to (i) immediately notify us of unauthorized account access or security breaches, (ii) use reasonable efforts to maintain confidentiality, and (iii) assist us in enforcing rights and complying with security breach notification laws. Use caution when accessing your account on public computers. We can disable any account credentials at any time if you violate these Terms.

Term and Termination. For paid subscriptions, Services renew annually unless either party gives 30-day notice of non-renewal before term end. As a user or job seeker, you can terminate your account anytime. NEOGOV may terminate your account or Service access anytime, with or without cause or notice, at its discretion. NEOGOV may alter, suspend, or discontinue Services without notice and is not liable for any Service changes or access suspension/termination.
Our rights to use and disclose your feedback survive termination.

Intellectual Property Rights. Services and all content, features, and functionality (NEOGOV Content), are owned by NEOGOV and protected by US and international intellectual property laws. These Terms allow personal, non-commercial use of Services, and internal business use for Customers, under these Terms. No other rights are granted.
● Your computer may temporarily store copies in RAM while accessing materials.
● You may store browser-cached files for display enhancement.
● For downloadable apps, you may download one copy for personal, non-commercial use, agreeing to our end user license agreement.
No Service or content rights are transferred to you. All rights not expressly granted are reserved by us. Unauthorized Service use breaches these Terms and may violate copyright, trademark, and other laws.

Trademarks. “NEOGOV,” “NEOED”, “Governmentjobs.com,” “Schooljobs.com,” “PowerDMS,” and related names/logos are our trademarks. Related product names, design marks, and slogans are our trademarks or service marks, excluding partner marks. Do not use our marks without written permission. We retain rights in color schemes and column names in Services. The “look and feel” of Services are also our trademarks or copyrights.

Prohibited Uses. Use Services lawfully and according to these Terms. You must not:
- Submit or post malicious software.

Further, you agree not to use Services:
- Violating any law or regulation.
- Exploiting or harming minors.
- Unlawfully using others’ personal information.
- Transmitting unauthorized advertising or spam.
- Sending unsolicited communications.
- Responding to job opportunities for reasons other than applying for the job.
- Engaging in conduct that disrupts Services or exposes NEOGOV or users to harm or liability.
- Using automated means to access or copy Services data without permission.
- Attempting unauthorized Service access.
- Testing Service vulnerability or breaching security measures.
- Overloading Service infrastructure or interfering with Service operation.
- Attacking Services via denial-of-service attacks.
- Accessing Services to build competitive products or copy Service features.
If Service use requires industry-specific regulatory compliance, you are solely responsible for compliance. You may not use Services in ways subjecting NEOGOV to such regulations without prior written agreement.
Limit your access level to necessary tasks. Notify NEOGOV immediately if you believe you have inappropriate access.

Monitoring and Enforcement; Termination. We may monitor Services to (1) comply with laws, (2) operate Services and protect interests, and (3) for other necessary purposes. We have the right to:
- Remove or refuse User Contributions.
- Take action on User Contributions violating Terms, creating liability, damaging our brand, interfering with services, or being abusive, illegal, or harmful.
- Disclose your identity to third parties claiming your posted material violates their rights.
- Take legal action for unauthorized Service use.

- Infringe intellectual property rights.

Text Message and Email Communications. We may offer text and email notifications for notices, reminders, updates, support, and HR-related communications from us or Customers, routed through third-party services.
SMS messages are sent with your explicit opt-in. To opt out, reply “OPTOUT”. To opt back in, reply “OPTIN”. Job seekers can manage SMS preferences in account settings, by contacting the Customer, or NEOGOV Support.
By allowing SMS, you agree to receive texts on your mobile phone, including via automated systems, and certify you own or are authorized to use the phone for SMS.
You are responsible for mobile carrier charges from Service use and notifications. Message frequency varies. You may get a subscription confirmation text. NEOGOV may suspend or terminate SMS for any reason without notice.
Text services depend on third-party providers, causing potential delays. NEOGOV strives for timely and accurate alerts but cannot guarantee delivery, timeliness, or accuracy and is not liable for delays, delivery failures, errors, or actions taken based on alerts. If your number changes, inform the Customer. NEOGOV disclaims warranties regarding telecommunication services, security intrusions, and data disclosure related to Services.

Copyright Infringement. Our policy is to respond to DMCA-compliant infringement notices. Copyright-infringing material can be identified and removed. Comply with our process for infringement claims.
If you believe your copyrighted work is infringed, provide our copyright agent with written information as specified by DMCA. This process is for copyright infringement notices only. We do not make legal decisions on infringement validity. Upon valid notice, we will remove or block access to allegedly infringing content and may contact the notice provider for more information. - Right to Opt-Out of E-Signatures. You can opt out of E-Signatures and sign documents manually by notifying the sending party and getting a non-electronic copy. Do not use E-Signatures if signing manually. NEOGOV is not responsible for providing non-electronic documents.
- Electronic Download. After signing electronically, you can download and print a free paper copy. To withdraw E-Signature consent later, notify the sending party and stop using E-Signatures. Past electronic signatures remain legally valid even if you later opt out.
- E-Signature Validity. NEOGOV statements on electronic document validity are for information only and not legal advice. Electronic signatures on some agreements may not be enforceable under law.
