This Policy does not cover: (1) personal data managed by our Customers (employers using our Services), which is governed by separate agreements with them; (2) data collected by external sites linked to or accessible from our Services; (3) personal data our partners collect directly from you; (4) data from our employees or job applicants applying to NEOGOV; and, (5) De-Identified Platform Data. De-Identified Platform Data is non-personal data derived from personal data that is aggregated, anonymized, or de-identified so it cannot reasonably identify you. We use this data to provide insights to Customers, improve our Services, and develop new features. Because it cannot identify you, we can use and share De-Identified Platform Data as we see fit.
We are the data controller for the personal data discussed in this Policy, except where explicitly stated in the “Where We Are a Service Provider” section.
Where We Act as a Service Provider
Our Customers are diverse organizations, including government agencies at all levels (federal, state, local, tribal), private sector businesses, and educational institutions (K-12 schools, universities, vocational schools). They utilize our Services primarily for evaluating job applicants and managing their workforce. When we offer Services to these Customers, they generally control the personal data collected (which may include sensitive data like biometrics for time tracking, precise location, health information, and demographic details related to employment). In these cases, we act as a “data processor” or “service provider” under data protection laws. Our legal duties as a processor are defined in our agreements with Customers. Crucially, our Customers, not us, decide what personal data to collect and how it is used in managing their relationship with you.

For example, if you apply for a job with a Louisiana state agency through our platform, or if your employer uses our Services for workforce management, the personal data related to your application or employment is generally controlled by that agency or employer (our Customer). Information from Other Sources
We receive your personal data from various third-party sources: your employer (our Customer), data brokers, partners (including Marketplace partners), accreditation agencies, and event/webinar co-organizers/sponsors.
Partners: We use data from partners for joint product and marketing opportunities. For example, we get profile data on background checks and assessments, payment updates, communication analytics, and profile data from integrated systems Customers connect to our Services. If you sign in with Facebook or other single sign-on services, we import requested data from your account.
Data brokers: We purchase contact data to improve and correct our collected data, including name, email, phone, employer, job title, and expertise.
Public sources: We collect data from public websites and government sources, like name, email, job title, employer, and professional expertise.
We combine data from your Service use with data from third parties and use it according to this Policy.

Information Collected When Using the PowerLine Application
The PowerLine App (“App”) is designed to improve mental wellbeing by providing information and connecting you with others with similar experiences. If your employer sponsors your App access, we collect minimal data to set up access (name, email). Your interactions within the App are anonymous to other users, who will only know you by an anonymous ID. Be cautious about sharing personal data in the App. We collect data only as necessary for your interaction with the App, including:
- Measurement data: App version, device model, OS version, language/region settings, timestamp.
- Crash reports: Data when the App crashes, including device state, model, OS version, and software processes causing the crash.
- App usage and interactions: Statistics on user behavior to understand App interaction and for error reporting.
Information We Disclose.
We share personal data with other parties for the purposes stated here or as legally required. Below are categories of entities we’ve shared data with, including in the past year.
To Customers.
We disclose personal data to our Customers (current or potential employers). For example, if you apply for a job, we share your data with the employer. If your employer uses our Services, your data input is accessible to their authorized users, subject to their security settings. If you subscribe to Access membership, we may share your data with Customers and their agents for recruitment. You can cancel Access membership anytime.
To Service Providers.
We share data with service providers who perform services for us, such as support, data security, email, web hosting, research and analytics, data enrichment, marketing and advertising, payment processing, payroll, customer conferences, and customer relations management.
Research and Event Partners/Sponsors
We collaborate with entities for research, under privacy-protective controls. We publish insights as aggregated, anonymized, de-identified, or non-personal data.
If you access content or attend our events/webinars, we may share your data with sponsors. Sponsors may also be data controllers, and their privacy policies will apply to their processing of your data.
To Advertising Partners
As detailed in “Online Analytics and Advertising,” we may share your data with third parties for tailored advertising. We may also allow third-party ad technologies to use cookies and similar technologies on our Services for targeted content and ads on our Services and other websites/apps.

We may share data with your consent or if you publicly post it. Legally required consent is obtained before data transfer. For example, we share data with background check providers with applicant consent and Customer instruction.
During Service use, you may link to third-party websites not affiliated with us. We have no control over these sites. They may collect your data, and you should review their privacy policies.
To other third parties where required by law.
We disclose data to comply with laws, regulations, legal processes, or government requests; investigate violations and enforce policies (Terms of Service, this Policy, contracts); detect, prevent, or address fraud; protect rights, property, or safety of users or the public; protect vital interests; and for legal claims or where disclosure is legally required.
Mergers, Acquisitions, Dissolutions, Affiliates.
We may transfer data to another entity in case of acquisition, merger, consolidation, purchase of assets, or bankruptcy. We share data with affiliates with Customer consent to facilitate Service transitions or implementations.
International Users
We are based in the United States, and collected information will be transferred to, processed, and stored on our US servers, according to this Privacy Policy and US law. US data protection laws may differ from your country’s laws. We take appropriate steps to protect your data and transfer it only in compliance with this Policy and applicable law, including using standard contractual clauses or other legal mechanisms.

Marketing Communications

Your Rights and Control under EU GDPR.
Data Controllers and Processors.
Our Customers use Services for job postings, applicant evaluation, HR management, and workforce training. Customers control what personal data is collected, used, retained, and disclosed. Under GDPR, Customers are data controllers, and we are data processors in these cases. In other instances (cookies, service communications), we determine processing means and purpose.
Lawful Basis for Processing.
For data subject to GDPR and ePrivacy Directive, we rely on several legal bases:
Consent: We ask for consent to process data for certain purposes, like marketing. You can withdraw consent anytime, but this does not affect prior lawful processing. Withdraw consent via prompts in messages, account settings, or by contacting support.
Legitimate Interest: We process data for our legitimate interests, including support, marketing (lawful), security, service improvement. We balance our interests with your rights and risks before processing for legitimate interests.

We use an automated chatbot in some Services to screen requests and questions for FAQ fulfillment, request tagging, routing to appropriate contacts, and service/response improvement. The chatbot is not fully automated and does not have legal or significant impact on you.
Data Security and Integrity.
We implement physical, technical, and administrative safeguards to maintain data accuracy, integrity, security, prevent unauthorized access, and ensure proper data use. Security measures consider risks to you and Customers, technology availability, industry practices, mitigation effectiveness, and sustainability.
Despite these controls, data transmission is not risk-free, and absolute security is not guaranteed. You are responsible for keeping login credentials (username, password) confidential.
Retention and Removal.
For personal data where we determine processing purposes, we retain data no longer than necessary for the original collection purpose, when no longer relevant, or upon permissible request. When the original purpose ends, we will delete or de-identify data (if lawful) or securely store it until deletion is possible. Data is disposed of to prevent reconstruction or reading. For job applicants, De-Identified Platform Data may be retained after account closure as permitted by law.
When our Customer is the data controller, our retention policies are designed to enable Customer compliance with their record retention needs. If a job applicant deletes their profile, personal data is removed or de-identified from our applicant database, but may persist in applications submitted to Customers until Customer disposal. Job applicants should contact the Customer to enforce data rights in applications.
Right to Revise.
We may revise this Policy to reflect changes in our practices or legal compliance by posting a new version on our website. Material changes will be appropriately communicated as legally required. By continuing to use Services, you confirm you have read and understood the latest Policy version.

If you use a SaaS Application for a Customer, you are bound by these Terms and the Privacy Policy, and are responsible for actions through your account, including third-party product/service use and data disclosure. If added to a SaaS Application, the Customer administering it controls your use, including access, permissions, and third-party integrations. Content you submit may be retained, accessed, used, modified, shared, or removed by the Customer. Your account may be managed by the entity controlling your email domain.
Please read these Terms carefully before using the Services.
We may update these Terms periodically at our discretion. Changes are effective immediately upon posting and apply to all subsequent Service access and use. Continued use after changes means you accept them. Check this page regularly for updates, as they are binding.

Eligibility. Services are for users 18 or older. By using Services, you warrant you are of legal age to contract with us. If not, do not use the Services. We are based in California, USA. Services may be accessed internationally, but access may be illegal in some countries. If accessing Services outside the US, you are responsible for local law compliance. Access from illegal territories is prohibited. You are responsible for US and applicable export law compliance.

Accessing Services and Account Security. Subject to these Terms, we grant you a limited, revocable, personal, non-transferable, non-exclusive license to use Services. Unless a Customer Contract allows Service use for Customer transactions, use Services only for your transactions. If using Services for a Customer or entity, you warrant authorization to do so. To access Services, you may need to provide registration details or other information. All information provided must be correct, current, and complete and is governed by the Privacy Policy. You consent to actions taken with your information consistent with our Privacy Policy. Undefined terms have meanings in the Privacy Policy.
If you choose or are provided with login credentials, treat them as confidential and do not share them. Your account is personal, and you must not provide access to others.
Between you and others (including Customers), your account is yours. However, if a Customer purchased Services for your use, they can control access and get usage reports.
You agree to (i) immediately notify us of unauthorized access or security breaches, (ii) assist us in maintaining confidentiality, and (iii) help us enforce rights and comply with security breach notification laws. Use caution when accessing your account from public computers. We can disable any username, password, or identifier if you violate these Terms.

Term and Termination. For paid subscriptions (e.g., employers purchasing Services), subscriptions are annual and auto-renew unless either party gives 30-day non-renewal notice via email. If using Services as a user or job seeker, you may terminate your account anytime. NEOGOV may terminate your account or Service access at any time for any reason, with or without notice, at its discretion. NEOGOV may modify, suspend, or discontinue Services without notice and is not liable for any Service changes or access termination.
Our rights to use your feedback survive termination.

Intellectual Property Rights. Services and all content, features, functionality (“NEOGOV Content”) are owned by NEOGOV and protected by US and international copyright, trademark, patent, trade secret, and other intellectual property laws. These Terms permit Services use for personal, non-commercial use, or Customer internal business use under these Terms’ license rights. No license to NEOGOV Content is granted except as follows:
● Your computer may temporarily store copies in RAM while accessing and viewing materials.
● You may store cached files for display enhancement.
● You may download a single copy of downloadable apps for personal, non-commercial use, agreeing to our end user license agreement for such apps.
No rights to Services or content are transferred to you, and all ungranted rights are reserved. Any unauthorized Service use breaches these Terms and may violate copyright, trademark, and other laws.

Trademarks. “NEOGOV,” “NEOED,” “Governmentjobs.com,” “Schooljobs.com,” “PowerDMS,” and certain logos are our trademarks, as are related product and service names, design marks, and slogans, excluding partner marks. You must not use these marks without written permission. We retain rights in designated color schemes and column names within Services. The “look and feel” of Services (color combinations, button shapes, layout, design, and graphical elements not uploaded by Customers) are also our trademarks or copyrights.

Prohibited Uses. Use Services only lawfully and according to these Terms. You must not:
- Submit or post harmful code (viruses, worms).
- Create false identities, misrepresent identity, create profiles for others, post false resume data, or use another’s account.
- Disclose information without consent (confidential Customer information).
- Reproduce, distribute, modify, create derivatives of, publicly display, perform, republish, download, store, license, sell, transfer, transmit, or copy NEOGOV Content or Services.
- Delete or alter legal notices, copyright, trademark, or proprietary rights notices.
- Reverse engineer, decompile, disassemble, or attempt to access source code or algorithms of Services or underlying software.
- Commercially use Services or content (except for Customer internal business use).
- Use Services or NEOGOV Content in a way that causes confusion, disparages NEOGOV, interferes with Services, or infringes on another’s Service use.
- Violate NEOGOV or others’ intellectual property rights, including unauthorized copying or distribution of content.
Further, you agree not to use Services:
- Violating any law or regulation (including export laws).
- Exploiting, harming, or attempting to harm minors.
- Unlawfully using others’ personally identifiable information.
- Transmitting unsolicited advertising without consent (spam, chain letters).
- Sending unsolicited communications or contacting users who requested not to be contacted.
- Responding to job opportunities for reasons other than applying for the job.
- Engaging in conduct that restricts others’ Service use or harms NEOGOV or users.
- Using automated devices (robots, spiders) to access, copy, or monitor Services or NEOGOV Content.
- Attempting unauthorized Service access or access to connected systems/networks.
- Scanning or testing Service vulnerability or breaching security measures.
- Taking actions that overload Service infrastructure or interfere with Service operation.
- Attacking Services via denial-of-service attacks.
- Accessing Services to build competitive products or copy Service features.
If your Service use requires industry-specific regulatory compliance, you are solely responsible. You may not use Services in a way that subjects NEOGOV to such regulations without prior written agreement (e.g., handling “protected health information” under HIPAA).
Your access level should be limited to necessary tasks. Notify NEOGOV immediately if you believe you have inappropriate access.

Monitoring and Enforcement; Termination. You agree we may monitor Services to (1) comply with laws, (2) operate Services and protect our and users’ interests, and (3) for other necessary purposes. Specifically, we can:
- Remove or refuse to post User Contributions for any reason.
- Take action regarding User Contributions we deem necessary, including for violations of these Terms or Content Standards, potential liability, brand damage, user loss, ISP issues, abusive content, illegality, rights violations, harm to users/public, or law infringement.
- Disclose your identity to third parties claiming your posted material violates their rights.
- Take legal action for unauthorized Service use.
- Terminate or suspend your Service access for any reason, including Terms violations.
You waive and hold harmless Governmentjobs.com, Inc. and affiliates from claims resulting from actions taken during or as a result of investigations by Governmentjobs.com, Inc. or law enforcement.
We are not responsible for screening, policing, editing, or monitoring postings and encourage user discretion. We assume no liability for actions regarding user/third-party content. We have no liability for performance or nonperformance of activities in this section.

Content Standards. These apply to all User Contributions and Service use. User Contributions must comply with all laws and regulations and must not:
- Be defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or objectionable.
- Promote sexually explicit material, violence, or discrimination.
- Infringe intellectual property or other rights.
- Violate legal rights or give rise to civil or criminal liability or conflict with these Terms and Privacy Policy.
- Be likely to deceive.
- Promote illegal activity.
- Cause annoyance, inconvenience, or anxiety.
- Impersonate or misrepresent identity.
- Involve commercial activities (contests, sales promotions, advertising).
- Imply endorsement by us if not the case.
You are responsible for the legality, accuracy, and completeness of all records, data, and information you provide.

User Contributions. Services may contain Interactive Services (message boards, forums, job boards) allowing users to post materials (“User Contributions”). All User Contributions must meet Content Standards. Any User Contribution you post is non-confidential and non-proprietary. You grant us and affiliates a royalty-free, perpetual, irrevocable, transferable, non-exclusive license to use, reproduce, distribute, modify, adapt, publish, translate, and display User Contributions worldwide, without approval or consideration, in any media. You waive any related claims. We are not a publisher of User Contributions and are merely an intermediary. We are not responsible for deletion or storage failure of postings and advise against posting confidential information.
We are not obligated to edit or control User Contributions and are not liable for them. You may be exposed to inaccurate, offensive, or objectionable User Contributions. You waive any rights against NEOGOV regarding User Contributions. NEOGOV disclaims liability for User Contributions. If notified of non-compliant User Contributions, NEOGOV may investigate and remove them at its discretion, without notice.
You are responsible for your User Contributions, including legality, reliability, accuracy, and appropriateness. We are not liable to third parties for content or accuracy of User Contributions posted by you or others.

Text Message and Email Communications. We may offer text message and email notifications about notices, reminders, updates, support, administrative messages, and HR-related notices from us or Customers. Communications may be through third-party services.
SMS messages are sent according to your preferences and only after opt-in. To opt out, reply “OPTOUT”. To opt back in, reply “OPTIN”.
Job seekers can manage SMS in account preferences, by contacting the Customer related to the message, or NEOGOV Support at [email protected].
By allowing SMS, you agree to receive text messages, including those sent by automated dialing systems. You confirm you own or are authorized to use the mobile phone for SMS.
You are responsible for mobile carrier data and text message charges. Message frequency varies. You may get a subscription confirmation text. NEOGOV can suspend or terminate SMS for any reason without notice.
SMS services depend on third-party providers, so technical delays may occur. NEOGOV will try to provide timely and accurate alerts but cannot guarantee delivery, timeliness, or accuracy. NEOGOV is not liable for delays, delivery failures, misdirected delivery, errors, or actions taken based on alerts. If your number changes, inform the Customer. NEOGOV makes no warranties regarding telecommunication services, security, or data disclosure related to SMS.

Copyright Infringement. Our policy is to respond to DMCA-compliant infringement notices. Copyright-infringing material on Services can be identified and removed via our process. You agree to comply with this process.
If you believe your copyrighted work is infringed, provide our copyright agent with the written information below. This procedure is solely for notifying us of copyright infringement. We do not make legal decisions about infringement validity or defenses. Upon receiving a valid notice, we will remove or block access to infringing content and may notify the alleged infringer (“Alleged Infringer”). The Alleged Infringer can send a counter-notification. Notices and counter-notices are legal notices and may be published or shared. False notices are subject to DMCA damages. Consult an attorney if unsure about infringement.
To file a DMCA notice, send a written letter by regular mail only to our DMCA agent (address below). We may ignore non-compliant notices.
DMCA notice must:
- Identify copyrighted work(s) infringed.
- Identify infringing content and provide location information. Include screenshots for identification.

Changes to the Services. We may update Service content, but it may not be complete or current. Service material may be outdated, and we are not obligated to update it.

Relay of Content. NEOGOV relays content including resumes, applications, messages, and questionnaire answers. You authorize NEOGOV to send this content on your behalf. We process, monitor, review, store, and analyze content for data analysis, security, quality control, Terms enforcement, content moderation, and Service improvement. Content may be delayed or undelivered due to technical issues. NEOGOV may notify you in such cases. By using Services, you acknowledge this activity is necessary for Service quality and provisioning.

Linking to the Services and Social Media Features. You may link to our homepage fairly and legally without damaging our reputation or implying endorsement without written consent. We may disable social media features and links anytime without notice.

Additional Terms for Third-Party Services. Services may help users access third-party services outside NEOGOV Services (PowerLine, PowerEngage) or integrated services (background checks, skills assessors). NEOGOV does not perform or employ individuals to perform these services and does not supervise, direct, control, or monitor these third parties.

Links and Third-Party Content. Services may contain links to third-party sites and resources for convenience. We have no control over these sites, their content, or resulting loss or damage. We disclaim responsibility for third-party materials, programs, products, and services accessed through Services, and for any loss or damage from dealings with third parties on Services. Accessing third-party websites is at your own risk and subject to their terms and conditions. Read all third-party service terms.

Specific Third-Party Providers.
Background Checks: Some Services allow using third-party background check services. If you use background check services, you authorize NEOGOV to obtain your background check report, including criminal and eviction history, and share it with Customers you apply to, agreeing to background check company terms of use. If you are personnel using background checks for a Customer, use reports legally and agree to background check company terms.

NEGOV is not an employer. NEOGOV does not control employer HR practices or employment decisions. Employers are responsible for their postings. NEOGOV is not considered an employer and is not responsible for employment decisions made by entities posting jobs on Services. Employers are responsible for privacy, data collection, use, retention, and processing of employer-owned data, and providing required notices, in compliance with laws.

NEOGOV is not a healthcare provider. NEOGOV may provide access to healthcare services. NEOGOV is not a healthcare provider; its role is limited to providing telehealth information and facilitating access to telemedicine and medical services. NEOGOV is independent of telemedicine providers and not responsible for their actions, omissions, or communications. NEOGOV does not practice medicine.
Services do not provide medical advice or create a healthcare provider/patient relationship with NEOGOV. Services and content are for informational purposes only and do not replace healthcare provider advice. Consult your doctor for medical questions and for medical emergencies, call 911 or your doctor. NEOGOV is not liable for advice, treatment, diagnosis, or information obtained through Services.

NEOGOV’s Disclaimers. We do not guarantee files from Services are virus-free. You are responsible for anti-virus protection and data accuracy, and for maintaining external means for data reconstruction.
NEOGOV is not liable for damages, costs, or consequences from Service delays or inability to deliver due to events beyond reasonable control, including acts of God, law changes, labor problems, transportation delays, supply unavailability, fire, riot, military action, or government actions.
NEOGOV does not control data flow to/from Services and the internet, which depends on third-party internet services. Third-party actions may impair internet connections. While NEOGOV will try to remedy such issues, it cannot guarantee they won’t occur and disclaims liability resulting from such events.
Service use, content, and obtained items are at your own risk. Services are provided “AS IS” and “AS AVAILABLE” without warranties. NEOGOV does not warrant Service completeness, security, reliability, quality, accuracy, or availability, or that Services will be error-free, uninterrupted, or meet your needs.
NEOGOV disclaims all warranties, express or implied, including merchantability, non-infringement, and fitness for a particular purpose, to the fullest extent of law.

Limitation on Liability. To the maximum extent of law, NEOGOV, its affiliates, licensors, service providers, employees, agents, officers, and directors are not liable to you or any entity for damages arising from this Agreement, including Service use or inability to use, under any cause of action, for any consequential, indirect, incidental, special, or exemplary damages, including personal injury, emotional distress, loss of revenue, business opportunity, profit, use, goodwill, data, or business interruption, even if foreseeable.
Except for damages from NEOGOV’s gross negligence or willful misconduct, NEOGOV’s total liability under this Agreement shall not exceed US$100.00.
These limitations do not affect liability that cannot be excluded or limited by law.

Indemnification. To the extent permitted by law, you agree to indemnify and hold harmless NEOGOV, its affiliates, licensors, and service providers, and their personnel from claims, liabilities, damages, losses, costs, expenses, or fees (including attorney’s fees) arising from your violation of these Terms or Service use, including User Contributions, unauthorized Service content use, or use of information obtained from Services.

E-Signatures.
- E-Signature Provisioning & Consent. NEOGOV E-Forms and electronic signature services (“E-Signatures”) are for two parties (typically employers and personnel/job seekers) to electronically sign documents. By using E-Signatures, you agree to statements in this Section. Signing documents via E-Signatures means you consent to electronic signatures and transactions, and confirm you can access E-Signatures and electronically signed documents. Consent applies only to the specific document signed.
- Right to Opt-Out of E-Signatures. You are not required to use E-Signatures. Job seekers/personnel can manually sign documents by notifying the sending party and obtaining a non-electronic copy. NEOGOV is not responsible for providing non-electronic copies. If manually signing, do not use E-Signatures.
- Electronic Download. After electronically signing and returning a document, NEOGOV offers free download and printing. To withdraw E-Signature consent later, notify the sending party and stop using E-Signatures. Past electronic signatures remain legally valid.
- E-Signature Validity. NEOGOV’s statements on electronic document validity are for informational purposes only and not legal advice. Electronic signatures on some agreements may not be enforceable under law. NEOGOV disclaims responsibility for ensuring electronic signatures are valid or enforceable under any jurisdiction. Consult legal counsel on document validity when using NEOGOV E-Signatures.
